Overview
- Mr Justice Brian Cregan ruled the proceedings against the Disciplinary Appeals Panel moot and directed that a new panel be constituted without any prior members.
- Gardaí removed Enoch Burke from the High Court after he refused to follow directions, and the hearing was set to continue with him attending by videolink from Mountjoy Prison.
- Two members of the original tripartite panel had resigned and Burke objected to the remaining ASTI representative, Geraldine O’Brien, with a letter stating none of them will sit on any reformed panel.
- The judge struck out the case, stated that the named defendants cannot take further steps on the appeal, ordered Burke to pay the day’s costs, and declined to award him expenses.
- Counsel for Wilson’s Hospital School’s board, Rosemary Mallon, sought to add the board as a notice party and proposed a reconstituted panel drawn from the TUI or an independent body such as the Law Society, Bar Council or ICTU.
